Emergency Mental Health Laws with Alan Clough – JCU Law Seminar Series

Each year, tens of thousands of individuals with severe disturbances in mental capacity require urgent care in emergency departments. While most are treated under the PHA, focusing on protecting public health by transporting individuals to treatment facilities, about one in five are treated under the MHA, emphasising the least restrictive care for those with mental illness. This seminar will explore Parliament’s rationale for these distinct pathways, assess the effectiveness of these laws, and examine their human rights implications. Professor Alan Clough (PhD, LLB) is a distinguished public health academic renowned for his contributions to substance use and mental health research. He has built a significant career focused on addressing the social determinants of health in rural and Indigenous communities, particularly in Northern Australia. His expertise spans epidemiology and public health policy evaluation. Alan earned his PhD in Epidemiology from Charles Darwin University’s Menzies School of Health Research and his LLB from Queensland University of Technology. He has held an academic and research position at James Cook University for twenty years. His work is characterised by a deep commitment to collaboration with local communities, ensuring that research and policy interventions are properly informed and effective. Alan has published extensively in peer-reviewed journals. His research influences policy and practice, helping to shape public health strategies at both local and national levels. In recognition of his work, he has received numerous grants and awards. Beyond his academic achievements, Professor Clough is known for his mentorship and dedication to fostering the next generation of public health researchers. His legacy is marked by a commitment to improving health equity and outcomes for some of the most vulnerable populations in Australia.
