There are lots of questions being asked about the state government's new measures seeking to vaccinate 75% of the workforce holding approximately 1.1 million jobs:• Have Public Health Orders been issued for these mandates?• Does Section 51 clause xxiiiA of the Australian constitution make state vaccination mandates illegal?• Does the federal Biosecurity Act (2015) have any role in the determination of these state vaccination mandates?• Does the Commonwealth Privacy Act (1998) mean that your employer can not request your vaccination status?• Do employers have the right to mandate vaccinations?• What role can Worksafe and/or Fairwork Australia play for workers who are questioning employers vaccine mandates?• How should you respond to correspondence from your employer presenting you with a vaccine mandate?• Does failure to have a COVID-19 `vaccination' by a date specified by the employer constitute a breach of discipline?• Can the employer use a breach of discipline to deduct annual leave, long service leave, and other entitlements?• Are there likely to be class actions regarding vaccine mandates? If you think about it, the answers to most of these questions are not easy and depend on individual circumstances.Get an understanding of the legal framework upon which millions of workers will make important decisions over the next weeks and months.
